Terms and Conditions (T&Cs) for Kazaar Fragrances
Jurisdiction
These Terms and Conditions (T&Cs) apply to all contracts between the online store (hereinafter referred to as the "Seller") and the customer (hereinafter referred to as the "Customer") that are concluded via the Seller's website. Any terms and conditions of the Customer that conflict with or deviate from these terms and conditions shall not be recognized unless the Seller has expressly agreed to their validity in writing.
Conclusion of Contract
(1) The presentation of the products in the online store does not constitute a legally binding offer, but a non-binding online catalog. By clicking on the "Buy" or "Send order" button, the customer places a binding order for the goods contained in the shopping cart. Confirmation of receipt of the order follows immediately after the order has been sent and does not yet constitute acceptance of the contract. The contract is concluded when the seller confirms acceptance of the order by sending an order confirmation by e-mail or by delivering the goods.
(2) The seller is entitled to refuse to accept orders without giving reasons.
Prices and Terms of Payment
(1) All prices quoted are in euros (EUR) and include statutory VAT.
(2) The customer has the option of paying by credit card or PayPal. The seller reserves the right to exclude certain payment methods in individual cases.
Shipping and Shipping Costs
(1) Delivery takes place within Switzerland, Liechtenstein, Germany, Austria and neighboring EU countries.
(2) The delivery time is usually 2-5 working days from order confirmation, unless expressly stated otherwise in the item description.
(3) The Seller accepts no liability for delays in delivery caused by force majeure, natural disasters or other events beyond the Seller's control.
(4) The shipping costs are to be borne by the customer and are displayed in the order process.
(5) Kazaar will pay the shipping costs for orders over 100 euros.
Right of Withdrawal and Returns
(1) Due to our hygiene regulations, we cannot take back used or opened fragrances. Soiled, used, opened or damaged goods will not be taken back and will be returned to the sender. The return costs and the shipping risk to our returns department are to be borne by the buyer in all cases.
(2) The costs incurred if the customer has provided an incorrect address, even if it is only an additional address, will not be covered by Kazaar under any circumstances. We are not liable for lost packages due to a partially complete or incorrect delivery address.
(3) Cancellations cannot be guaranteed as Kazaar works with an automated logistics system. Once your package has been shipped, it cannot be canceled.
(4) In the event of damage, Kazaar has the right to demand evidence proving the damaged goods. If no such evidence can be provided, we are not liable for the damage.
(5) Orders which include a discount cannot be returned.
(6) The Swiss right of withdrawal applies to the entire online store. When purchasing, you agree to all points.
Warranty and Liability
(1) The warranty shall be governed by the statutory provisions of the Swiss Code of Obligations.
(2) The Seller shall not be liable for damage that has not occurred to the delivery item itself, in particular not for loss of profit or other financial losses of the Customer.
Data Privacy
(1) The customer's data required for business transactions shall be stored and processed in compliance with data privacy laws.
(2) The customer has the right to information, correction, deletion or blocking of his stored data at any time.
(3) The complete data privacy policy can be viewed on the seller's website.
Discovery Kit Conditions:
The Discovery Kit is a product offered free of charge by Kazaar.
It includes 5 samples of selected fragrances.
The customer is obliged to pay the shipping costs to receive the Discovery Kit.
Each customer may only order and receive one (1) Discovery Kit.
In case of an order of more than one (1) Discovery Kit, only one (1) Kit will be delivered, regardless of the quantity ordered.
Kazaar reserves the right to change or update these terms and conditions at its sole discretion. Any changes will be posted on the Kazaar Fragrances website and will be effective from the date of posting.
The Discovery Kit is subject to Kazaar's Terms and Conditions.
Kazaar reserves the right to terminate or modify this Sale at any time.
The Sale is valid from October 19th, 2023 until October 30th, 2023.
Terms and Conditions (T&Cs) for the Black Friday and Black Week prize draw:
- Duration of the promotion: The promotion starts on November 20th at 00:01 AM and ends on November 26th at 11:59 PM.
- Conditions of participation: During the promotion period, every customer will receive one prize draw ticket for every euro spent. Discounts are not taken into account when awarding tickets. Example: Original price 100 euros - 20% discount = 80 euros = 80 raffle tickets.
- Prize draw items: The prize draw includes the following items:

3.3 100 grams of Swiss gold (Raiffeisen)

- Implementation of the prize draw: The prize draw will be held in mid-December.

Legal provisions: The promotion and prize draw are carried out in compliance with the applicable laws and regulations of Switzerland. The promotion is not connected to Facebook, Instagram or other social media platforms.
- Changes and termination of the promotion: The company reserves the right to change the terms and conditions of the promotion at any time. In the event of attempted fraud, technical problems or other unforeseen circumstances, the promotion may be canceled or suspended.

Disclaimer: The company accepts no liability for technical problems, losses or delays in connection with participation in the promotion or the prize draw.
- Data privacy: The data collected as part of the campaign will be treated in accordance with data privacy regulations. Information on this is available on the company's website.
- Prize collection - Rolex, Cartier and gold: The winners of the Rolex Datejust Grey Dial, the Cartier Santos and the 100 gram Swiss gold are obliged to collect their prizes in person from our Headquarters Office in Switzerland. It is not possible to send these prizes.
- Shipping of Rimowa suitcases: The Rimowa suitcases (Check-In L Classic and Cabin Classic) will be shipped to the winners from Switzerland. The usual shipping policy applies.
- Free entry: Participants have the opportunity to take part in the prize draw free of charge. This can be done by sending a written request to Kazaar LLC, 254 Chapman Rd, Ste 208 #15427 Newark, Delaware 19702 US. The details of the free entry will be provided to the participant after the request has been reviewed.
By participating in the promotion, the customer agrees to these terms and conditions.
Black Week Special Provision: Right Of Return:
Orders placed during Black Week from 11/20/2023 to 11/23/2023 are subject to a special return policy. In accordance with this policy, products purchased during this period cannot be returned or exchanged unless they are defective or damaged.
Legal provisions: This special regulation does not affect the statutory rights of the customer in accordance with the applicable consumer protection regulations.
This Black Week special applies exclusively to orders placed during the above-mentioned period and does not affect the regular right of return outside this period.
Final provisions
(1) The law of the Swiss Confederation shall apply to contracts between the seller and the customer. The application of UN and/or EU sales law is expressly excluded.
(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the customer and the seller shall be the seller's registered office.
(3) Should individual provisions of these terms and conditions be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions.

Provisional terms and conditions for the summer sale and lottery

- Scope of application
These terms and conditions apply to the Summer Sale from July 1st to July 7th, 2024 and the associated lottery. -
Conditions of participation
Participation in the competition is open to all orders from Germany, Switzerland and Austria. There is no minimum age for participation.
Orders placed before the promotion period cannot be canceled or refunded to take advantage of the promotion.
- Promotion period
The summer sale takes place from July 1st to July 7th, 2024. - 3-for-2 promotion
When purchasing 3 fragrances, the cheapest fragrance is provided free of charge. - Prize draw mechanism
Every euro spent during the promotion period counts as one ticket for the prize draw. Amounts after the decimal point are rounded up or down according to the systematic rounding system (e.g. €39.90 equals 40 entries). - Prize
The prize is a Rimowa Classic Check-In L suitcase worth €1,540.00, filled with 98 inspired fragrances (49 per side) worth €4,890.20. The total value of the prize is €7,000. The winner will be drawn at random no later than two weeks after the end of the promotion (July 21st, 2024) and then contacted by all possible means. For data protection reasons, only the winner's order number will be disclosed. The winner's name will not be published. - Collection of the prize
The suitcase must be collected from the organizer in Switzerland.
Shipping is possible at the winner's request, but the organizer accepts no liability for damage, loss or incorrect delivery during transport. The value of the goods is too high for adequate insurance. - Data Privacy
No additional data is collected. Only the order number and the amount spent during the promotion period are required for participation in the competition. The existing data privacy guidelines continue to apply. - Disclaimer
The organizer is not liable for technical problems that could affect participation in the prize draw. The organizer is not liable for loss or damage to the prize during transport if the winner wishes to have it shipped. Free participation in the competition
In order to comply with the legal requirements of the Gambling Act, we offer a free entry variant. - Free entry: Send a handwritten letter with your full name, address, a valid e-mail address and your previous experience with Kazaar to our company address (see imprint)
Quantity: Each customer can only complete this process once.
Ticket allocation: Each handwritten letter counts as one ticket in the competition, the ticket will be allocated after receipt and processing. If the letter reaches us after the end of the campaign, we will not be able to allocate you a prize. The letter must reach us during the campaign period. - Final provisions
Legal recourse is excluded. These terms and conditions supplement the Organizer's existing terms and conditions and shall apply for the duration of the Summer Sale and the lottery.
